Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Moto Coach AI mobile application (the "App") provided by Moto Coach AI ("Moto Coach AI", "we", "us", or "our"), a California corporation.

By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to create a Moto Coach AI account. By creating an account, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

If you are uploading videos that include minors (for example, footage of your child or a rider you coach), you confirm that you are their parent, legal guardian, or coach with permission to upload that footage on their behalf.

2. What the service does

Moto Coach AI is an AI-powered motocross coaching service. You upload short riding video clips. We analyze each clip using computer vision and large language models to produce coaching feedback, scores, and recommended drills.

The coaching we provide is informational only. It is not professional instruction, medical advice, or a guarantee of any rider outcome.

Motocross is an inherently dangerous activity. You are solely responsible for your own safety, your riding decisions, your equipment, and your riding environment. Always ride within your ability, wear appropriate safety gear, and follow local laws and track rules.

3. Your account

You sign in to Moto Coach AI using Sign in with Apple. You are responsible for:

You may delete your account at any time from the in-app Settings → Account → Delete account flow, or by emailing us at support@motocoachai.app.

4. Your content

You retain ownership of every video you upload and every piece of content you submit ("Your Content").

By uploading or submitting Your Content, you grant Moto Coach AI a worldwide, non-exclusive, royalty-free license to:

This license ends when you delete the content or your account, except for anonymized and aggregated insights that have already been used to improve our models.

You are responsible for ensuring you have all rights necessary to upload Your Content, including the rights of any people who appear in it.

6. Subscriptions and payments

If and when we offer paid subscriptions through the App, those subscriptions are billed through Apple's In-App Purchase system in accordance with Apple's terms. Subscription pricing, renewal terms, and refund eligibility will be disclosed at the point of purchase.

7. Service availability and changes

We work hard to keep the App available and useful, but we don't promise that it will be uninterrupted, error-free, or available in any particular location or at any particular time.

We may modify, suspend, or discontinue any part of the App at any time, with or without notice. We may add or remove features as we improve the product.

8. AI-generated content disclaimer

The coaching, scores, and recommendations the App produces are generated by AI based on the limited information in your uploaded video clip. They may be inaccurate, incomplete, or wrong. You should use your own judgment and consult qualified human coaches or medical professionals for personalized instruction or guidance.

We make no guarantees about the accuracy of any AI-generated output.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED OUTPUT.

We do not warrant that the App will meet your requirements, that it will be uninterrupted or error-free, or that any defects will be corrected.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTO COACH AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

You agree to indemnify and hold harmless Moto Coach AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

We may suspend or terminate your account and access to the App at any time, for any reason, with or without notice, including for violations of these Terms.

You may stop using the App and delete your account at any time.

Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

Any dispute arising out of or relating to these Terms or the App shall be resolved in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

You agree to bring any claim against us within one year after the claim arises, or you waive that claim.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and, for material changes, notify you in the App. Your continued use of the App after the change takes effect means you accept the updated Terms.
